These Terms of Use (the “Terms”) set forth the conditions for using the members-only atelier space provided by Shared Atelier Kochi (the “Atelier”). By completing the application and payment, the applicant (the “Member”) is deemed to have agreed to these Terms.
Article 1 (Purpose of Agreement)
The Atelier grants Members the right to use the shared atelier space operated by the Atelier (the “Premises”).
Article 2 (Term and Renewal)
The membership starts on the date the application is completed and automatically renews on a monthly basis unless and until the Member submits a cancellation request.
Article 3 (Fees and Payment Method)
- The monthly membership fee is JPY 42,000 (tax included).
- No enrollment fee is charged.
- Payments are processed each month via a secure payment service designated by the Atelier and charged automatically to the registered credit card, etc. The initial charge occurs at sign-up and subsequent charges occur on the same calendar day each month (or as defined by the payment provider if that day does not exist in a given month).
- Payment processing and card data management are handled by the payment provider; the Atelier does not store card information.
Article 4 (Cancellation)
- Members must submit a cancellation request via the dedicated cancellation page or other method designated by the Atelier at least one month before the desired cancellation date.
- One additional month’s fee will be charged after the cancellation request. No proration or refunds are provided.
- Automatic billing continues until the cancellation procedure is fully completed.
Article 4-2 (Cooling-Off)
- Within 7 days from the contract date, Members may request cancellation in writing or by email and receive a full refund of fees already paid.
- However, if the Member has used the Premises two or more times after the contract date, the cooling-off does not apply and no refund will be issued.
- Bank transfer fees for refunds are borne by the Member.
Article 5 (Facilities and Equipment)
- The Premises include shared facilities such as lockers, water facilities, and a refrigerator.
- If a locker key is lost, the Member shall compensate JPY 10,000.
- Please be considerate of other users when using shared equipment and facilities.
Article 6 (Responsibility for Stored Items)
- Members may store artworks and materials at the Premises, which may include a roofed outdoor area without locks.
- All risks of theft, loss, or damage to stored items are borne by the Member. The Atelier assumes no liability.
Article 7 (Parking)
- Free on-site parking is available (guideline: approx. two standard cars and three kei cars).
- Parking is first-come, first-served; reservations are not accepted.
- The Atelier is not liable for any accidents, theft, or disputes in the parking area.
Article 8 (Overnight Use)
- The Premises have restroom and bath facilities. Members may bring a sleeping bag for temporary overnight use (e.g., late-night work or naps).
- The Premises are not intended as a residence; continuous residential use is prohibited.
- Long-term consecutive overnight stays or de facto residential use are prohibited.
- The Atelier is not liable for any fire, theft, accidents, or health issues associated with overnight use.
- Even during overnight use, please be considerate of other users.
Article 9 (Rules and Prohibited Conduct)
- Acts that significantly disturb other Members, bringing hazardous materials, damaging facilities, and any illegal acts are prohibited.
- Members must follow the Atelier’s safety and hygiene instructions.
Article 10 (Service Suspension and Force Majeure)
The Atelier may temporarily suspend services due to disasters, power outages, inspections, or similar events. The Atelier is not liable for delays or suspensions caused by unavoidable circumstances.
Article 11 (Disclaimer)
The Atelier is not liable for any damages arising in connection with the Member’s use of the Premises, except in cases of willful misconduct or gross negligence by the Atelier.
Article 12 (Changes to the Terms)
The Atelier may revise these Terms as needed. Revised Terms take effect when posted on the website.
Article 13 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any disputes arising in connection with the services shall be subject to the exclusive jurisdiction of the Kochi District Court or Kochi Summary Court in the first instance.
